1. Acceptance of Terms

By accessing or using PostOtter (“the Service”, “we”, “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

PostOtter is an AI-powered tool that generates, schedules, and publishes social media content to third-party platforms (TikTok, Instagram, X) on behalf of the user. The Service requires you to connect one or more third-party social media accounts via OAuth.

3. Account & Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. Third-Party Platforms

Your use of connected platforms (TikTok, Instagram, X, etc.) is governed by the terms and policies of those platforms. PostOtter is not affiliated with, endorsed by, or sponsored by any of these platforms. You agree to comply with all applicable third-party terms, including content guidelines, posting limits, and API usage rules.

5. User Content

You retain ownership of any content you submit to the Service. By using the Service, you grant PostOtter a non-exclusive, worldwide, royalty-free license to store, process, generate derivative works from, and transmit your content solely as required to operate the Service (including posting on your behalf to connected platforms).

You are solely responsible for any content posted to your social accounts via the Service, whether authored by you or generated by the Service’s AI tools.

6. Acceptable Use

You agree not to use the Service to:

• Publish content that violates any law or third-party platform policy
• Generate or publish hateful, harassing, sexually explicit, deceptive, or harmful content
• Spam, mass-message, or otherwise circumvent posting limits on connected platforms
• Reverse engineer, scrape, or attempt to gain unauthorized access to the Service
• Use the Service to impersonate any person or entity

7. Subscription & Billing

Paid plans are billed in advance on a recurring basis (monthly unless otherwise specified). Subscriptions auto-renew until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct we believe violates these Terms or harms other users, third parties, or the Service itself. You may delete your account at any time.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for any particular purpose.

10. Limitation of Liability

To the maximum extent permitted by law, PostOtter shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
